1. Who we are

RushWave (rushwavegame.com, the "Site") is a trading name of RushWave Sport Ltd, a company registered in England and Wales under company number [COMPANY_NUMBER], with its registered office at 175 Piccadilly, London W1J 9TB, United Kingdom ("we", "us" or "the operator").

2. What we offer — and what we do not

RushWave provides free-to-play social games in the style of slot machines and other casual entertainment, including Razor Returns, Mount M, Book of Dead, Fishin' Frenzy Even Bigger Catch, Action Bank and Bull in a Rodeo. These games are for entertainment only.

We do not offer real-money gambling. Nothing on this Site is gambling within the meaning of the Gambling Act 2003: you do not pay or stake any consideration for the chance of winning money or money's worth, and no prize of money or money's worth can be won. We are not a casino, a lottery operator, a bookmaker or a betting service, and we hold no gambling licence in New Zealand, the United Kingdom or anywhere else.

Practice or success at social casino gaming does not imply future success at real-money gambling. Real-money gambling works differently, involves financial risk, and is regulated separately in New Zealand.

3. You must be 18 or older

The Site is available only to people aged 18 and over. By using it you confirm that you are at least 18. We check age at the entrance to the Site and may ask for proof at any time. If we find that a user is under 18, we will block access and delete the account and the data connected to it.

The same requirement applies before you follow the link to the mobile game featured on the Site.

4. Virtual coins

You receive virtual coins inside the games. They are part of the game mechanics and have no monetary value. Virtual coins:

• cannot be cashed out, exchanged, transferred or redeemed for money, goods or prizes;
• are not a balance, a deposit, credit or a means of payment;
• remain our property at all times; you receive only a revocable, personal and non-transferable licence to use them inside the games;
• are forfeited without compensation if your account is closed, suspended or deleted;
• give rise to no claim for compensation if a game or the Site is discontinued.

Trading virtual coins outside the Site, selling them and exchanging them for anything of real value is prohibited.

5. Your account

Some features require an account. You agree to give accurate information, to keep your login details confidential and to tell us at RushWaveSport@proton.me about any unauthorised use. One account per person is allowed. We may suspend or close an account where these Terms are breached, in particular for false statements about age, multiple accounts, manipulation of the games, or abusive behaviour towards other users or our support team.

6. The games on this Site

Games may be added, changed or removed at any time. Some titles shown on the Site are produced by third parties and appear here under licence or with the permission of the relevant rights holders. All third-party trade marks, logos and game titles remain the property of their owners; their appearance on the Site does not imply any association with those owners or any endorsement by them.

We are not associated with, endorsed by or sponsored by any casino, lottery operator, sportsbook or other real-money gambling operator.

7. The mobile game we link to

The Site links to the mobile game Tower Turbo Win, which is distributed through Google Play. That game is published on Google Play by a third party and is not developed or operated by us. Downloading and installing it happens at Google Play, not on this Site, and your use of it is governed by the terms of Google Play and by the terms shown in that listing.

We are not responsible for the availability, content, functioning, updates or removal of that listing, for any purchases made inside it, or for the handling of your information by Google or by the publisher of that game. If you have a problem with the app itself, contact its publisher or Google Play support.

8. Acceptable use

You agree not to use the Site in order to:

• bypass security measures, the age check or access restrictions;
• use automated scripts, bots, crawlers or emulators;
• manipulate game outcomes, scores or coin balances;
• copy, distribute or commercially exploit the content of the Site;
• transmit unlawful, offensive or harassing content;
• make the Site available to anyone under 18.

9. Intellectual property

All content on the Site — software, graphics, text, audio, the RushWave name and logo, and the layout — is protected and belongs to us or to our licensors. You may not copy, adapt, reproduce or distribute it without our written permission, except as the law expressly allows.

10. Availability and changes

We aim to keep the Site running, but we do not promise uninterrupted availability. We may change, restrict or discontinue games, features or the Site as a whole. We will announce material changes to these Terms on the Site; the version in force is always the one published here. If you continue to use the Site after a change, you are taken to have accepted it.

11. Liability

The games are provided "as is". To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or loss of data.

Nothing in these Terms limits or excludes any right or remedy you have that cannot be limited or excluded by law. If you are in New Zealand, that includes your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these Terms limits our liability for death or personal injury caused by negligence, or for fraud.

12. Responsible play

13. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are resident in New Zealand and use the Site as a consumer, this does not deprive you of the protection of the mandatory consumer laws of New Zealand, and you may also bring proceedings in the New Zealand courts where the law allows.
